Detailed Terms of Providing PrivMX.cloud Service by Simplito

1. This document contains detailed terms of Client’s and User’s (your) use of PrivMX.cloud Service (Service). This document constitutes Detailed Terms in understanding of Terms of Services Provided Electronically by Simplito sp. z o.o. (the Terms).
2. Definitions indicated within the Terms shall apply to these Detailed Terms.
3. In matters on regulated by the Detailed Terms, the Terms shall apply.
4. PrivMX.cloud Service is provider to Clients and Users free of charge, as part of trial access.
5. We reserve the right to terminate test access to the Service at any time, without prior notice to Clients. This includes the right to disable the Service in its entirety and to cease further provision of the Service. We also have the right to change the conditions under which the Service is provided, including the commencement of charging for the provision of the Services. If you do not agree to such change, we may block your access to the Service.
6. The Service should be treated as a beta version, intended for testing and carrying out development work, not constituting a final product. We would like to point out that the Service may not work properly, and its use may involve errors, defects or malfunction of certain functionalities. By being a Client or a User, you accept this fact and acknowledge that we do not give any guarantee for the correctness and stability of the PrivMX.cloud Service.
7. In connection with the provision of the Service, we perform monitoring of the use of bandwidth, computing power, memory and other IT resources that we make available to our Clients. This monitoring is performed on an ongoing basis. Due to the fact that the Service is made available as part of early access, we are not able to precisely determine the maximum limits of use of the Service at any given time. However, we reserve the right to unilaterally decide to limit the scope of use of the Service, including in terms of the permissible use of IT resources by all or some Clients, in particular when we consider that the consumption of the indicated resources is excessive. We may make a decision in this regard without prior notification to Clients.
8. The Service Provider's liability for damages caused by the use of the Services is excluded to the fullest extent permitted by law.
